Terms of Service

These Terms of Service ("Terms") govern your use of RMBR.ME (the "Service"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract to use RMBR.ME. You are responsible for keeping your account credentials secure and for all activity under your account.

2. What RMBR.ME is — and is not

RMBR.ME lets you create a memorial and interact with an AI representation of a person built from the photos, memories, and details you provide. The chat replies, voices, and videos the Service produces are AI-generated approximations. They are not the actual words, likeness, or wishes of any real person, living or deceased, and should not be relied upon as such. The Service is intended for remembrance and personal reflection. It is not a source of medical, legal, financial, or other professional advice.

3. Your content

You retain ownership of the photos, memories, and other content you upload ("Your Content"). You grant us a limited, non-exclusive license to store, process, and display Your Content solely to operate the Service for you — including sending the content needed to our AI and infrastructure providers to generate chat replies and videos. We do not use Your Content to train our own models, and we do not sell it.

You represent that you have the right to upload Your Content and to create a memorial of the person it depicts, and that doing so does not violate the rights of others or any law.

4. Acceptable use

You agree not to use the Service to:

• Impersonate a living person in a deceptive or harmful way, or create a memorial you have no right to create.
• Upload unlawful, infringing, or abusive content, or content depicting others without a lawful basis.
• Harass, defame, or harm others, or violate anyone's privacy or publicity rights.
• Attempt to break, overload, reverse-engineer, or gain unauthorized access to the Service.
• Resell or commercially exploit the Service except as expressly permitted.

We may suspend or remove content or accounts that violate these Terms.

5. Plans, billing, and cancellation

• Paid plans are billed in advance on a recurring basis through our payment processor, Stripe.
• Subscriptions renew automatically until cancelled. You can cancel at any time; access continues through the end of the paid period.
• Plan limits (such as the number of memorials, chat messages, and video generations per month) are described on our pricing page and enforced by the Service.
• Except where required by law, payments are non-refundable. Prices may change on a prospective basis with notice.

6. AI output and no guarantee of accuracy

AI systems can produce inaccurate, unexpected, or inappropriate output. We do not guarantee that generated content will be accurate, appropriate, or faithful to the person being remembered, and you use it at your own discretion. If output is upsetting, you can stop using the feature at any time.

7. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the fullest extent permitted by law, RMBR.ME and its operators will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data or content. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive.

10. Changes to these Terms

We may update these Terms as the Service evolves. We will revise the "Last updated" date above and, for material changes, take reasonable steps to notify you. Continued use after changes take effect means you accept the updated Terms.
